Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of meritmindz.com and the Merit Mindz platform (together, the “Service”), operated by Webmaddy Private Limited (“we”, “us”, “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. The Service

Merit Mindz provides coaching institutes with tools to manage students, test series, study material, admissions and ecommerce. Specific features, pricing and service levels for an institute are set out in the order form, quotation or agreement signed with that institute, which takes precedence over these Terms where they conflict.

3. Accounts

• You must provide accurate information when creating an account and keep it up to date.
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• Institutes are responsible for the accounts they create for their staff and students.
• Tell us immediately at admin@meritmindz.com if you suspect unauthorised use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Upload content that infringes someone else’s intellectual property, or that is harmful, obscene or misleading.
• Attempt to gain unauthorised access to the Service, other accounts or our systems.
• Copy, resell, reverse engineer or interfere with the Service, or disrupt its normal operation.

5. Content & Intellectual Property

The Service, including its software, design, logos and content we provide, is owned by Webmaddy Private Limited and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use it for its intended purpose.

Institutes retain ownership of the content they upload (such as questions, study material and student data). You grant us the permission needed to host, process and display that content solely to provide the Service to you.

6. Fees & Payments

Paid plans are billed as agreed with your institute. Fees are non-refundable except where stated in your agreement or required by law. Payments made by students to an institute through the institute’s store are handled between the student and the institute; the institute is responsible for its own pricing, refunds and delivery.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use personal information.

8. Third-Party Services

The Service may link to or integrate with third-party services (such as payment gateways, Calendly, WhatsApp, Facebook and Instagram). We are not responsible for those services, and your use of them is subject to their own terms.

9. Disclaimer & Limitation of Liability

The Service is provided “as is” and “as available”. We do not guarantee that it will be uninterrupted or error-free.

To the maximum extent permitted by law, Webmaddy Private Limited will not be liable for any indirect, incidental or consequential damages, or loss of data, profits or revenue, arising from your use of the Service. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

10. Suspension & Termination

We may suspend or terminate access to the Service if you breach these Terms or if required by law. You may stop using the Service at any time. Termination of a paid plan is governed by your agreement with us.

11. Governing Law

These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.

12. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on this page with the “Last updated” date shown above. Continued use of the Service after changes means you accept the updated Terms.
